1. Acceptance of these Terms
These Terms form an agreement between you and Elixo Bots regarding your use of elixoai.com, user accounts, software, bots, analytics, notifications, and related functionality (the "Services").
By creating an account, connecting an exchange or wallet, purchasing access, or using the Services, you accept these Terms, our Privacy Policy, and our Cookie Policy. If you act for an organization, you confirm that you may bind it.
2. Eligibility and legal responsibilities
You must be at least 18, legally able to enter a binding agreement, permitted to use crypto and automated trading where you live, and authorized to control every connected account or asset.
You are responsible for applicable laws, taxes, reporting duties, exchange rules, sanctions, and licensing requirements. Feature availability does not mean a feature is lawful or suitable in every jurisdiction.
3. What Elixo Bots provides
The Services may include DCA bots, AI trade analysis, pair trading, futures arbitrage, spread and funding tools, market data, charts, alerts, exchange or wallet connections, payments, credits, affiliate tools, and beta features.
Not an exchange, custodian, or adviser
Elixo Bots is software and information infrastructure, not an exchange, broker, bank, wallet, custodian, fiduciary, or investment adviser. Trading funds generally remain with your exchange or wallet. Information and outputs are not individualized financial, legal, or tax advice.
4. Trading and technology risks
Crypto markets, futures, leverage, short selling, arbitrage, pair trading, and funding strategies can cause partial or total loss and, in some cases, liabilities beyond the initial position.
Results may be affected by volatility, slippage, liquidity, fees, funding changes, liquidation, rejected or partial orders, latency, price-feed errors, exchange outages, API changes, cyber incidents, and third-party insolvency. Backtests, APR, statistics, and past results do not guarantee future performance. You alone choose strategies, settings, and risk limits.
5. Accounts and security
Provide accurate information and protect your password, email, devices, sessions, and recovery methods. You are responsible for activity under your account.
Notify help@elixoai.com immediately if you suspect unauthorized access. Do not sell, share, lease, or transfer an account, impersonate another person, or create accounts to evade restrictions.
6. Exchange, wallet, and API connections
When you connect a provider, you authorize Elixo Bots to retrieve permitted data and send requests such as creating, changing, or canceling orders.
- Connect only accounts you may control.
- Grant the minimum required permissions and disable withdrawals where possible.
- Use IP restrictions, subaccounts, and provider security controls.
- Revoke credentials immediately after suspected compromise.
You remain bound by each provider's rules. We do not control its security, solvency, data, execution, or API availability.
7. Automated features and AI
Automated trading
Enabled automation may send order instructions without separate approval for every order. Review leverage, size, direction, risk rules, balances, and exchange mode, and monitor active bots.
AI and beta features
AI outputs may be incomplete, inaccurate, delayed, or inconsistent. Verify LONG, SHORT, WAIT, confidence, and risk labels independently. Beta or experimental functions may fail, change, or be discontinued without notice.
8. Trials, plans, payments, and credits
Features, trial periods, prices, limits, billing cycles, and renewal terms shown on the website or at checkout form part of these Terms. Future pricing may change without retroactively increasing a completed purchase.
Crypto payments require the correct asset, network, amount, address, and reference and are generally irreversible. Unless law or checkout terms require otherwise, fees are non-refundable after digital access or credits are delivered. Send verified duplicate or technical-error claims promptly to help@elixoai.com.
AI Credits and internal balances are accounting units for designated features, not money, deposits, securities, or crypto assets.
9. Acceptable use
Do not use the Services for unlawful, fraudulent, manipulative, abusive, or sanctioned activity; manage third-party assets without required authority; attack or bypass security; introduce malware; overload undocumented interfaces; reverse engineer or resell protected parts; misrepresent identity; infringe rights; or harm users, providers, or market integrity.
We may investigate suspected abuse and cooperate with providers or authorities where legally required.
10. Third-party services
The Services may depend on exchanges, blockchains, wallets, data sources, charting tools, AI providers, Google, payment processors, Telegram, analytics, and other parties. Their own terms and policies apply.
We do not control their content, fees, data, security, outages, or decisions. A third-party change may affect an Elixo Bots feature without notice.
11. Intellectual property and feedback
Elixo Bots and its licensors own the Services, software, interfaces, designs, text, graphics, logos, databases, and related rights. You receive a limited, personal, non-exclusive, non-transferable, revocable right to use the Services as intended.
You retain your submitted content and grant us the limited rights needed to host, process, secure, and provide it. We may use feedback without restriction or compensation, without publicly identifying you without permission.
12. Availability, updates, and support
We do not promise uninterrupted, timely, secure, or error-free operation. We may maintain, update, limit, modify, or discontinue features. Continued access may require updated software, browser versions, exchange settings, or credentials.
Support is provided through then-available channels, without a guaranteed response or resolution time.
13. Suspension, termination, and closure
You may stop using the Services and request account closure. Closure does not cancel requests already sent to an exchange, wallet, blockchain, or payment provider.
We may restrict or end access for breach, security or legal risk, unpaid fees, abuse, or loss of a required dependency. Provisions on fees, ownership, disclaimers, liability, and disputes survive where appropriate.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness, non-infringement, accuracy, and availability.
We do not promise profit, complete or current data, accurate AI output, successful order transmission or execution, or suitability for your needs. Rights that cannot legally be excluded remain unaffected.
15. Limitation of liability and indemnity
To the maximum extent permitted by law, Elixo Bots is not liable for indirect, special, punitive, or consequential loss, lost profit or opportunity, data loss, trading loss, liquidation, slippage, or lost crypto assets.
Aggregate liability will not exceed the greater of fees paid for the affected Service during the preceding three months or USD 100, except where law prohibits that limit. You will cover third-party claims caused by your unlawful use, breach, or infringement, except to the extent caused by our unlawful conduct.
16. Changes to Services or Terms
We may update these Terms for changes in services, technology, security, law, or business practices. We will post the new version and effective date and use reasonable additional notice for material changes.
Continued use after the effective date means acceptance where law permits. Otherwise, stop using the affected Services.
17. Applicable law and disputes
Before filing a formal claim, contact help@elixoai.com and allow a reasonable opportunity for informal resolution.
These Terms are governed by laws applicable to the relationship, without removing mandatory consumer protections. Unresolved disputes must be brought before a court or tribunal with jurisdiction under applicable law. If one provision is unenforceable, the rest remains effective.
